Terms of Service

These terms are the agreement between you and Heysnaps. We tried to keep them short and readable. By creating an album, paying for one, or uploading to one, you agree to them.

1. Who we are

Heysnaps is operated by Mag. (FH) Jürgen Neuhuber, sole proprietor, Obere Höllstraße 20d, 4451 Garsten, Austria (“Heysnaps”, “we”). You can reach us at hello@heysnaps.com.

2. What Heysnaps does

Heysnaps lets a host create a private album for an event. Guests add photos, videos and guest book messages by scanning a QR code or opening a link, without installing an app or creating an account. The host can view, download and remove the content, show it as a slideshow, and order printed products made from it.

3. Hosts and guests

A host is the person who creates or pays for an album. You must be at least 18 to be a host. We sign you in with a link sent to your email address, so keep access to that mailbox safe.

A guest is anyone who opens an album link. Guests do not need an account. Anyone who has an album's link or QR code can upload to it and, if the host allows it, view it. Share the link only with people you want in the album.

4. Prices, payment and taxes

Albums are sold for a one-time price per event. There is no subscription and nothing renews automatically. Prices are shown in US dollars before tax; any sales tax that applies is added at checkout. Payments are processed by Stripe. We do not see or store your full card number.

Add-ons such as the guest book, extra space, a storage extension or printed products are separate one-time purchases at the price shown when you buy them.

5. Refunds

If Heysnaps does not work as described, write to hello@heysnaps.com within 30 days of your purchase. We will fix the problem or refund what you paid for the album.

Printed products are made to order. If one arrives damaged or misprinted, send us a photo within 30 days of delivery and we will reprint it or refund it. We cannot refund a printed product because of how the photos in it look, or because of a typo in text you entered.

6. Your content

Photos, videos and messages belong to the people who made them. We do not claim ownership of anything uploaded to Heysnaps and we do not use it for advertising or to train machine-learning models.

By uploading, you give us permission to store, copy, resize, display and transmit that content as needed to run the album: showing it in the gallery and slideshow, preparing downloads, laying out a photo book or highlight video, and making backups. This permission ends when the content is deleted, apart from backups that expire on their normal schedule.

7. What hosts are responsible for

As a host you decide who gets the album link, what stays in the album, and what gets printed or shared. You are responsible for telling your guests that their uploads will be visible to you and, if you turn on the guest gallery, to other guests.

Only keep photos of people who are fine with being in the album, and take extra care with photos of children. If someone asks you to remove a photo of them, remove it. You can remove any upload at any time.

8. Acceptable use

Do not upload content that is illegal, that sexually exploits or endangers children, that harasses or threatens anyone, that infringes someone else's rights, or that contains malware. Do not try to access albums you were not invited to, overload the service, or resell it without our agreement.

We may remove content and suspend or close albums that break these rules, and we report apparent child sexual abuse material to the authorities as the law requires.

9. Copyright complaints

If you believe content on Heysnaps infringes your copyright, send a notice to dmca@heysnaps.com with: a description of the work, the album link or location of the content, your contact details, a statement that you have a good-faith belief the use is not authorized, a statement under penalty of perjury that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. We remove infringing content and close the accounts of repeat infringers.

10. How long albums are kept

Each plan includes a storage period, shown on the pricing page and in your album. You can download everything in original quality at any time during that period, and you can extend it. We email the host before an album expires. After it expires, the album and its content are deleted.

You can delete an album or individual uploads yourself at any time. Deletion cannot be undone.

11. Availability

We work hard to keep Heysnaps running, especially on weekends when most events happen, but we cannot promise that it will never be interrupted. Do not use Heysnaps as the only copy of photos that matter to you. Download your album after the event.

12. Disclaimers and limits of liability

Heysnaps is provided “as is”. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental or consequential damages, or for lost content, and our total liability for any claim relating to Heysnaps is limited to the amount you paid us in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law, or rights you have as a consumer that cannot be waived.

13. Governing law

These terms are governed by the laws of Austria, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory consumer laws of the place where you live, and you may bring claims in the courts there.

14. Changes

We may update these terms. If a change is significant, we will tell hosts by email or in the product before it takes effect. The terms that apply to an album are the ones in effect when it was purchased, unless the law requires a change or the new terms are more favorable to you.
